  2. The Website functions as an intermediary platform enabling the presentation of property sales offers and the booking of properties for short- and long-term rental, as well as contact with the Administrator and newsletter subscription.
  3. Use of the Website constitutes acceptance of these Terms & Conditions.

  1. Information, property descriptions, photographs, video materials, prices, and other content presented on the Website are for informational purposes only and do not constitute a commercial offer within the meaning of the Civil Code.
  2. Publication of a listing on the Website does not constitute an obligation to enter into a sale or rental agreement.
  3. Samaya Estates is not a party to a rental agreement unless explicitly stated otherwise in a given case.

4. Website Features

Within the Website, the user may in particular:

  • browse property sales and rental offers,
  • make a reservation for short- or long-term rental,
  • use the property matching quiz,
  • subscribe to the newsletter,
  • contact the Administrator via contact forms.

5. Property Rental Reservation

  1. The Website enables users to make property reservations for short- or long-term rental, in a manner similar to booking platforms.
  2. A reservation constitutes a binding date reservation, the purpose of which is to:
    • secure the availability of the property for the specified dates,
    • initiate the process of concluding a rental agreement.
  3. A reservation made via the Website does not constitute the conclusion of a rental agreement.
  4. The rental agreement is concluded directly between the user and the property owner or operator, at a later stage of the process, outside the Website.
  5. Specific reservation conditions, including in particular:
    • available dates,
    • price,
    • any reservation fee, deposit, or full payment,
    • cancellation and refund policies, are presented to the user before the reservation is confirmed.

6. Reservation Payments

  1. For selected offers, a reservation may require payment of:
    • a reservation fee,
    • a deposit,
    • or the full amount for the stay.
  2. Information about the nature of the payment, its amount, and the terms of refund or settlement is provided to the user before the reservation is made.
  3. Payments are processed through external payment operators.
  4. Samaya Estates may act as an intermediary in receiving payments.

7. Reservation Cancellation

  1. Cancellation conditions and any refund policies depend on the terms of a specific offer and are presented to the user before the reservation is made.
  2. The user is obliged to review the cancellation conditions before confirming the reservation.

8. Newsletter

  1. The Website allows users to subscribe to the newsletter.
  2. The newsletter is free of charge and includes information regarding:
    • Samaya Estates offers and services,
    • the real estate market,
    • news and educational content.
  3. Subscription is made by providing an email address and confirming the subscription.
  4. The user may unsubscribe at any time by clicking the unsubscribe link available in each message.

9. Contact with the Administrator

  1. The Website enables contact with the Administrator via contact forms and the email address provided on the Website.
  2. Submitting a contact form does not constitute the conclusion of a contract.
  3. The Administrator makes every effort to respond as promptly as possible.

10. Liability

  1. Samaya Estates exercises due diligence to ensure that the information presented on the Website is accurate and up to date.
  2. Samaya Estates is not liable for:
    • non-performance or improper performance of a rental agreement by the property owner or operator,
    • changes in property availability beyond the Administrator's control,
    • user decisions made based on the information provided on the Website.

11. Copyright

  1. All content available on the Website, including texts, photographs, video materials, graphics, and page layout, is protected by copyright.
  2. Use of the Website content is permitted solely for the user's personal use.
  3. Copying, distributing, or using the Website content for commercial purposes without the prior consent of the Administrator is prohibited.

12. Personal Data

The rules for processing users' personal data, including data provided in connection with reservations, newsletter subscriptions, or contact with the Administrator, are set out in the Privacy Policy available on the Website.

13. Complaints

  1. Complaints regarding the functioning of the Website may be submitted by email to: hello@samayaestates.pl.
  2. Complaints are processed within 14 days of receipt.

14. Changes to the Terms & Conditions

  1. The Administrator reserves the right to amend these Terms & Conditions for important reasons, in particular:
    • changes in legislation,
    • expansion of the Website's features,
    • technological changes.
  2. The current version of the Terms & Conditions is always available on the Website.

15. Final Provisions

  1. These Terms & Conditions are effective as of 23.03.2026.
  2. In matters not regulated by these Terms & Conditions, the provisions of Polish law shall apply.
