Remote purchase of real estate in Spain

For many people, buying real estate in Spain is still associated with long trips, nerves and the need to personally appear at the notary. However, the reality is very different today. The purchase of real estate can be carried out fully remotely, legally and safely, provided that the whole process is well prepared.
The key moment of any transaction is the signing of a notarial deed, that is, skrift de compraventa. Traditionally, this meant a personal presence with a notary in Spain. Today, in many cases it is not necessary, since Spanish law allows action by proxy.
Power of attorney. A tool that really makes life easier
If you buy, sell or inherit real estate in Spain or deal with a Spanish bank, it is very likely that your lawyer will offer you to sign a power of attorney (poder notarial).
It is a document that allows the designated person to act on your behalf. Most often this is a lawyer, but it also happens that a family member or a trusted friend becomes a proxy. Mutual powers of attorney between spouses are also a popular solution, allowing things to be done without the need for both parties to be present.
The scope of the power of attorney can be adjusted very precisely. It can include not only the signing of a real estate purchase agreement, but also a broader package of activities, such as:
- obtaining a NIE number,
- tax representation,
- opening a bank account in Spain,
- signing contracts with media suppliers,
- contact with authorities and banks.
What does the power of attorney look like from the formal side
The power of attorney must be signed before a notary. This can be done:
- in Spain,
- in the country of residence, for example, in Poland (then the document requires an apostille),
- in the Spanish Consulate.
The notarial cost in Spain is relatively small, and the document itself contains the data of both parties, the exact scope of powers and the date of signing. It is a solution that realistically saves time, money and logistics associated with travel, and with a well-chosen proxy, it also allows you to significantly speed up the entire process of buying real estate in Spain.
Important: the power of attorney can be revoked at any time. It is enough to sign with a notary a document revoking the authorization. The information goes to the lawyer, and the power of attorney ceases to be valid.

Remote purchase. What do you need?
NIE Number, mandatory for every property buyer in Spain. It can be obtained at the consulate or by proxy on the spot.
Bank account in Spain, necessary to settle transactions, taxes and fees. More and more banks are making it possible for non-residents to open an account online. An alternative is digital banks offering a Spanish IBAN number.
Remote cooperation with a notary, where the signature of the deed is carried out by a proxy who poses with the notary on your behalf.
And, of course, a proven lawyer and real estate agent in Spain. When buying at a distance, this is not an addition, but an absolute basis of security.
